HSBC Applicant Privacy Notice

This notice (“Privacy Notice”) applies to personal information relating to your application for employment with HSBC Group companies in Japan (i.e., The Hongkong and Shanghai Banking Corporation Limited, HSBC Securities (Japan) Limited, HSBC Global Asset Management K.K., and/or HSBC Services Japan Limited.).

It explains what information we collect about you, how we’ll use that information, who we’ll share it with, the circumstances when we’ll share it and what steps we’ll take to make sure it stays private and secure. This Privacy Notice covers all aspects of your interaction with HSBC in your capacity as an applicant, including recruitment and pre-employment screening and we may update this notice at any time.

Wherever we’ve said “you” or “your”, this means you or any authorised person who engages with us on your behalf (e.g. recruitment agencies you have authorised to liaise with us on your behalf).

When we say “we” or “HSBC”, we mean any or all of HSBC Group companies in Japan in respect of your personal information in your applicant capacity.

1. TYPE OF INFORMATION TO BE COLLECTED

In order to be considered for employment you will be asked to provide us with personal information. Examples of the type of information we may collect include your name, address, contact details, resume, education background, employment and compensation history, passport information, referees and results of employment checks.

If you choose not to provide any of the information requested, we may be unable to send you information, fully process your application or properly consider you for employment.

When providing us with the information, you represent that such information is accurate, complete, up to date and true and is supplied for the sole purpose of seeking job or employment vacancies or positions. You may also be invited to supply some diversity information as part of your profile including, but not limited to, your age range, gender or physical needs, if you wish. This information, if you decide to provide it, will be used only for reporting on the diversity of our candidate base across the organisation, or to assist if you have any special requirements as part of the recruitment process or your ongoing employment.

2. PURPOSE OF USE

When we collect your personal information, we may use it:

  • to assess and administer your application for employment;
  • to communicate with you in relation to your application;
  • to comply with any legal or regulatory obligations;
  • to monitor and review HSBC’s recruitment practices; and
  • to manage and administer employment

3. PROVIDING OF YOUR PERSONAL INFORMATION TO THIRD PARTIES

We will not provide your personal information to third parties without the prior consent of you, except as permitted by the relevant laws and regulations. However, in the case where we entrust handling of your personal information to third parties within necessary scope to achieve the purpose of use (including, but not limited to, recruitment agencies, referees and other relevant organisations including those that perform administrative and/or other services on our behalf during the recruitment process) or in the case of joint use as specified in item (4) below, we may provide your personal information even without prior consent of you.

For providing your personal information to third parties in foreign countries (including above cases of the entrustment of the handling of your personal information and the joint use of your personal information), we will not do so without getting prior consent of the customer for this provision, except the cases permitted by the relevant laws and regulations. For the avoidance of doubt, for a third party in foreign countries which prescribed by rules of the Personal Information Protection Commission (“PPC”) as a foreign country establishing a personal information protection system recognized to have equivalent standards to that in Japan, or a third party establishing a system conforming to standards prescribed by rules of the PPC as necessary for continuously taking action equivalent to the one that a personal information handling business operator shall take concerning the handling of personal information, we may provide your personal information to the third party without getting prior consent of the customer.

4. JOINT USE OF YOUR PERSONAL INFORMATION AMONG HSBC GROUP

We may jointly use your personal information with HSBC Group companies (which may be located outside Japan) as described below. This joint use will be made under necessary control measure, and when there are restriction set by applicable laws/rules such as Act on the Protection of Personal Information, we will comply with such laws/rules.

5. EMPLOYMENT CHECKS (VETTING)

It is part of HSBC’s recruitment policy that for certain positions you will be subject to certain employee vetting checks as required by HSBC. Your application cannot progress unless the check is conducted. We may collect personal data for vetting through the application and recruitment process directly from candidates, or carefully selected third party vendors may collect your personal information for vetting purposes for us. You may be asked to agree to separate terms and conditions upon such occasion.

6. SECURITY CONTROL ACTION

We are taking necessary and appropriate action for the security control to avoid data leakage, loss or damage of your personal information. In addition, we will exercise necessary and appropriate supervision over staffs and outsourced vendors who are handling your personal information.

7. DISCLOSURE, CORRECTION ETC. OF YOUR PERSONAL INFORMATION

You may request the following with respect to your personal information; to notify the purpose of use, to disclose, correct, add or delete, to cease using, to erase, to cease providing to third parties etc. We will respond to such request without delay.

8. GOVERNING LAW AND JURISDICTION

These terms and conditions and the rights and obligations contained hereunder shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have the exclusive jurisdiction to hear and determine any suit or proceeding, and to settle any dispute or claim, which may arise out of or in connection with these terms and conditions and the parties hereby irrevocably submit to the jurisdiction of such courts.
